Terms of Service

Please read these terms. Every account holder must explicitly accept them at sign-up. The most important things to understand: Somar's AI output can be wrong and is not professional advice — verify important work yourself; you own your content and are responsible for what you share and publish; and our liability to you is limited as set out in section 13, except where the law does not allow it to be.
1. The agreement
These Terms of Service ("Terms") are an agreement between you and Somar ("Somar", "we", "us") covering your use of the Somar apps, agents, publishing tools, websites (trysomar.com and sites.trysomar.com) and related services (the "Service"). You accept these Terms explicitly when you create your account, and your continued use of the Service means they continue to apply. If you use Somar on behalf of an organisation, you confirm you have authority to bind that organisation, and "you" includes it. Our Privacy Policy explains how we handle your data and forms part of this agreement.
2. Who can use Somar
You must be at least 13 years old (or the higher minimum age required in your country) and able to form a binding contract. You are responsible for your account and for keeping your sign-in method (Apple or Google) secure. Tell us immediately at support@trysomar.com if you suspect unauthorised access.
3. Plans, tickets and billing
- Plans. Somar offers Free, Plus, Team and Enterprise plans. Features, limits and current prices are listed on the pricing page, which forms part of these Terms. We may change plan features or prices prospectively; price changes take effect at your next renewal, and we will notify you first.
- Tickets. AI usage is metered in tickets. Daily tickets reset each day and do not roll over; monthly tickets reset on your billing date. Tickets have no cash value and are not refundable or transferable.
- Billing. Subscriptions renew automatically until cancelled. Subscriptions purchased on iPhone or iPad are billed through the App Store and are managed, cancelled and refunded under Apple's terms in your App Store account settings. Subscriptions started on the web are billed by our payment provider (Stripe) and are managed and cancelled on the website. Cancelling stops the next renewal; your plan remains active until the end of the paid period.
- Team billing. Workspace owners are responsible for seats they purchase. Adding members may add seats under your plan's per-seat pricing.
- Refunds. App Store purchases follow Apple's refund process. Web purchases are refundable where required by consumer law; otherwise fees are non-refundable.
4. Your content
- You own it. You retain all rights to the pages, messages, files, sites and other content you create or upload ("Your Content"). You grant us the limited, worldwide licence needed to host, process, transmit, display and back up Your Content in order to operate the Service — including sending it to our AI providers to generate the results you request, and serving publicly anything you choose to publish.
- You are responsible for it. You must have the rights to the content you upload, import or connect, and your use of it in Somar must not infringe anyone's rights or any law.
- AI output is yours to use, subject to these Terms and to the caution in section 6. To the extent we hold any rights in output generated for you, we assign them to you.
5. Sharing, publishing and collaboration
- Published sites are public. Publishing a page as a site makes it available to anyone on the internet and, if indexing is on, to search engines. You are solely responsible for what you publish — including its accuracy, legality, and any analytics tags you attach to it and their compliance with your visitors' privacy rights.
- Workspaces. Content shared into a workspace or teamspace is visible to its members under the permissions set. Workspace owners and admins control membership, roles, billing and (on Enterprise) audit logs. If your workspace is owned by your employer or another organisation, that organisation controls it.
- We may remove or unpublish content that violates these Terms or the law.
6. AI output — accuracy, limits and your responsibility
Somar can be incorrect. Somar's answers, summaries, citations, creations and agent work are generated by artificial intelligence. They can be inaccurate, incomplete, outdated or misleading — even when they sound confident, and even when they cite sources. Do your own research and verify output before relying on it.
- Not professional advice. Output is not medical, legal, financial, tax or other professional advice. For decisions that matter, consult a qualified professional.
- Review before you act. You are responsible for reviewing output before using, publishing or acting on it — especially agent actions. Agents act only with the permissions and connectors you grant, agent actions are logged and reversible where possible, and Somar never makes purchases, trades or sends communications without an authorised connector and your instruction.
- Similar output. AI models may produce similar output for different users; output may not be unique to you.
7. Connectors and third-party services
Connectors (such as Gmail, Google Drive, Outlook, Dropbox, SharePoint, Teams, Maps or custom MCP connectors) are optional and governed also by the third party's own terms. You authorise Somar to access the connected data when you invoke it. Custom MCP connectors run against servers you choose — vet them before connecting them, especially in a workspace. We are not responsible for third-party services, their availability, or their handling of your data.
8. Acceptable use
Do not use the Service to:
- break the law, or infringe others' rights (including privacy and intellectual property);
- generate or distribute malware, spam, deceptive content, or content that exploits or harms minors;
- publish sites that impersonate others, host phishing, or mislead visitors;
- attempt to access other users' accounts or data, probe or disrupt our infrastructure, or circumvent plan limits, metering or security controls;
- resell or white-label the Service without our written agreement.
We may suspend or terminate accounts that violate this section, and may report unlawful activity to authorities.
9. Enterprise and workspace administration
Enterprise features (SSO, SCIM provisioning, audit logs, security controls) are configured by workspace admins. Where an organisation provisions your account via SSO/SCIM, that organisation may create, manage, deactivate and delete your membership and access. Enterprise customers may have a separate written agreement with us; where it conflicts with these Terms, the written agreement wins.
10. Our service
- We work to keep Somar available and your data intact, but the Service is provided on an "as is" and "as available" basis. We do not promise uninterrupted or error-free operation, and features may change, be added or be withdrawn.
- We may update these Terms. For material changes we will notify you and ask you to accept the new version in the app; continued use after notice constitutes acceptance where re-acceptance is not required by law.
11. Intellectual property
The Service — including its software, design and branding — belongs to Somar and its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the apps as part of the Service. Don't copy, modify, reverse-engineer or create derivative works of the Service except where the law permits.
12. Termination
You can stop using Somar and delete your account at any time from Settings → Data Controls; deletion permanently removes your account and content. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service (in which case we will give reasonable notice so you can retrieve your content). Sections that by their nature should survive termination (including 4, 6, 13, 14 and 15) do survive.
13. Disclaimers and limitation of liability
- Consumer law comes first. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded — including under the Australian Consumer Law and equivalent protections elsewhere. Where liability can be limited, our liability for breach of such a guarantee is limited, at our option, to re-supplying the service or paying the cost of re-supply.
- To the maximum extent permitted by law, we exclude all implied warranties, and we are not liable for indirect, incidental, special or consequential loss, loss of profits, revenue, data or goodwill, or for decisions made or actions taken in reliance on AI output.
- To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and USD $100.
- Nothing in these Terms excludes liability that cannot be excluded, such as liability for fraud, or for death or personal injury caused by negligence.
14. Indemnity
If you use the Service in breach of these Terms — including publishing content you had no right to publish — and that causes a third-party claim against us, you will indemnify us for the reasonable losses and costs (including legal costs) that result, except to the extent we caused them.
15. Governing law and disputes
These Terms are governed by the laws of Australia, and courts located in Australia have non-exclusive jurisdiction over disputes — except that if you are a consumer in another country, you keep the benefit of your local mandatory consumer protections and courts. Before starting any formal dispute, contact privacy@trysomar.com — most issues can be resolved quickly.
16. App Store terms
If you downloaded Somar from Apple's App Store, Apple's standard licensed-application terms also apply. Apple is not a party to these Terms, has no obligation to provide support or maintenance for the Service, and is a third-party beneficiary of this section with the right to enforce it.
